Canada has followed the pattern of Benelux nations by legislating sufferingSuffering as the pivotal eligibilityEligibilitycriterionCriterion for euthanasiaEuthanasia/assisted death without requiring terminal prognosis as is needed in most permissive jurisdictions. This chapter will explore the relationship between sufferingSuffering and Medical Assistance in Dying (MAID) and the ways in which sufferingSuffering is understood in the Supreme Court of Canada, the federal Criminal Code legislation and by health care assessors. Based on this analysis, we will argue that the resulting sufferingSufferingeligibilityEligibilitycriterionCriterion leaves the law (...) open to unintended forms of interpretation, thus instituting perhaps the most unbounded and risk-prone form of assisted death in the world. A review of the literature on sufferingSuffering, the wish to dieWish to die, and reasons for MAIDReasons for MAID requests found sufferingSuffering of severe illness to be frequently associated with unstable mental health, social, and existentialExistential variables that are often amenable to therapy or remediation. Heterogeneity within MDD has hampered identification of biological markers (e.g., intermediate phenotypes, IPs) that might increase risk for the disorder or reflect closer links to the genes underlying the disease process. The newer characterizations of dimensions of MDD within Research Domain Criteria (RDoC) domains may align well with the goal of defining IPs. We compare a sample of 25 individuals with MDD compared to 29 age and education matched controls in multimodal assessment. The multimodal RDoC assessment included the primary IP (...) biomarker, positron emission tomography (PET) with a selective radiotracer for 5-HT1A ([11C]WAY-100635), as well as event-related functional MRI with a Go/No-go task targeting the Cognitive Control network, neuropsychological assessment of affective perception, negative memory bias and Cognitive Control domains. There was also an exploratory genetic analysis with the serotonin transporter (5-HTTLPR) and monamine oxidase A (MAO-A) genes. In regression analyses, lower 5-HT1A binding potential (BP) in the MDD group was related to diminished engagement of the Cognitive Control network, slowed resolution of interfering cognitive stimuli, one element of Cognitive Control. In contrast, higher/normative levels of 5-HT1A BP in MDD (only) was related to a substantial memory bias toward negative information, but intact resolution of interfering cognitive stimuli and greater engagement of Cognitive Control circuitry. The serotonin transporter risk allele was associated with lower 1a BP and the corresponding imaging and cognitive IPs in MDD. Lowered 5HT 1a BP was present in half of the MDD group relative to the control group. Lowered 5HT 1a BP may represent a subtype including decreased engagement of Cognitive Control network and impaired resolution of interfering cognitive stimuli. Future investigations might link lowered 1a BP to neurobiological pathways and markers, as well as probing subtype-specific treatment targets. (shrink)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

This chapter is about personhood in relation to ethics and to conciliar Christian theology, and how concepts of personhood may discriminate against profoundly cognitively disabled human beings. (By ‘conciliar Christian theology’ I mean the Christian theology that is articulated in, or endorsed by, the first seven ecumenical councils.) -/- I believe we can learn several things about personhood by looking at these two topics together. By examining ancient and medieval concepts of personhood and some modern conceptions of personhood we gain (...) a better grasp of the variety of concepts and what substantive work they were intended to do. By becoming familiar with (part of) the history of concepts of personhood we are better situated to appreciate and judge the theoretical work that these concepts were intended to do and what consequences they have in ethical and theological theorizing. -/- In the first section I tell a select history of moral philosophers theorizing about personhood and discuss these in relation to human beings with profound cognitive disability. I focus on John Locke, Immanuel Kant, and Mary Anne Warren. In the “When Personhood Is Discriminatory” section I argue that concepts of personhood, especially modern concepts of personhood, are typically used in a manner that discriminates against human beings with profound cognitive disabilities. I give two arguments against discriminatory uses of personhood, the Moral Shift Argument and the Argument against Exclusive Personhood. Although the Moral Shift Argument is deductively valid, it probably has little persuasive power over those who do not share the moral belief that profoundly cognitively disabled human beings are equal members of the moral community. However, the Argument against Exclusive Personhood has more argumentative force because it denies the claims that personhood is “self-evident” and that it is “obvious” to everyone. In the following section I survey a select history of concepts of personhood in order to establish the claims that concepts of personhood are not self-evident and are not obvious to everyone. This history of personhood goes back to ancient and medieval Christian theorizing and debating about personhood. It shows that concepts of personhood are not “self-evident” but rather are theoretical posits that are posited in theory construction in order to explain certain putative theological facts. Given that personhood is a theoretical posit and is not “self-evident,” moral philosophers who aim to determine the extent of the moral community on the basis of a supposedly “self-evident” concept of personhood are not justified in doing so. Moreover, given the Argument against Exclusive Personhood, philosophical theologians who wish to articulate models of the Trinity or Incarnation that are consistent with the seven ecumenical councils will find that they, like moral philosophers, are not justified to assume, or to insist on, modern personhood for their models of the Trinity or Incarnation. My overall conclusion, then, is that modern personhood is bad for ethics and unnecessary for conciliar ecumenical Christian theology. (shrink)

It remains unclear whether such genetic variants are associated with disease aggressiveness. The NCI-SPORE Genetics Working Group retrospectively collected clinicopathologic information and genotype data for 36 SNPs which at the time had been validated to be associated with PC risk from 25,674 cases with PC. Cases were grouped according to race, Gleason score and aggressiveness. Statistical analyses were used to compare the frequency (...) of the SNPs between different disease cohorts. After adjusting for multiple testing, only PC-risk SNP rs2735839 was significantly and inversely associated with aggressive and high-grade disease in European men. Similar associations with aggressive and high-grade disease were documented in African-American subjects. The G allele of rs2735839 was associated with disease aggressiveness even at low PSA levels in both European and African-American men. Our results provide further support that a PC-risk SNP rs2735839 near the KLK3 gene on chromosome 19q13 may be associated with aggressive and high-grade PC. Future prospectively designed, case-case GWAS are needed to identify additional SNPs associated with PC aggressiveness. (shrink)

This article revisits the account of magnanimity offered by Thomas Aquinas, in his Commentary on the Nicomachean Ethics of Aristotle and especially in his Summa Theologiae. Recent scholarship has viewed Aquinas' magnanimity as essentially Aristotle's, complemented by the addition of charity and humility to the classical moral horizon. By contrast, I read Aquinas as offering a subtle yet far-reaching critique of important aspects of Aristotelian magnanimity, a critique with roots in Aquinas' theology, yet also comprising a significant philosophic reappraisal of (...) Aristotle's account of human excellence. Against contentions that Aquinas' ethical revisionism is antithetical to civic common sense, the requirements of statesmanship, and the rational foundations of social science, I argue that Aquinas' theory is politically salutary and theoretically enlightening. Moreover, I suggest that recent dissident reflection on twentieth-century totalitarian experience underscores both the humanity and the nobility of a humility-informed magnanimity, such as that advocated by Thomas Aquinas. There are few successful applications of automated reasoning over OWL-formalised bio-ontologies, and requirements are often unclearly formulated. Of what is available, usage and prospective scenarios of automated reasoning is often different from the straightforward classification and satisfiability. We list nine types of scenarios and specify the requirements in more detail. Several of these requirements are already possible in practice or at least in theory, others are in need of further research, in particular regarding the linking of the OWL ontology to (...) data, reasoning over roles, and dynamically linking modular ontologies. Philosophy of technology is gaining recognition as an important field of philosophical scrutiny. This essay addresses the import of philosophy of technology in two ways. First, it seeks elucidate the place of technology within ontology, epistemology, and social/political philosophy. I argue technology inhabits an essential place in these fields. The philosophy of Henri Bergson plays a central role in this section. Second, I discuss how modern technology, its further development, and its inter-cultural transfer constitute a drive toward a global “hegemony (...) of technology”. The crux of the argument is that the technological impulse within humanity insinuates itself into nearly every aspect of human existence. The structures of the state, the economy, and culture, are each framed by this impulse. In the final analysis, it is argued that only a thorough examination of the intimate connection between humanity and technology can lay the foundation for a comprehensive philosophy of human existence. These magazines had the potential to become important voices in the professionalizing debate because of their national distribution. This study reveals that although journalists remained divided over the value of professionalism, they valued Editor & Publisher more than The Journalist because Editor & Publisher took a leadership role on the professionalism debate, defining professionalism and explaining what standards and group norms were expected from professional journalists. From about the fourth to the tenth century Buddhist monks in China engaged in formal, semi-public, religious disputation. I describe the Indian origins of this disputation and outline its settings, procedures, and functions. I then propose that this disputation put its participants at risk of performative contradiction with Buddhist tenets about language and salvation, and I illustrate how some chinese Buddhists attempted to transcend these contradictions, subverting disputation through creative linguistic and extra- linguistic strategies.

While Wallace disagreed with Darwin that domesticates provided a great deal of useful information on wild populations,71 Darwin continued to draw on his domesticated animals and plants to inform him on the workings of his theory. Unlike Wallace, his exposure to natural populations was extremely limited after his return from the Beagle voyage. By the 1850s, he had settled into a life at Down House and was becoming more and more withdrawn from London scientific circles. He turned to his network (...) of informants, visits from colleagues such as Hooker and T. H. Huxley, subscriptions to various journals, and his own experimental studies at Down.This work on domesticates was clearly related to other natural history studies conducted by Darwin and others during the same period. For example, during the 1850s when Darwin worked on domesticates, he was also engaged in questions of geographic distribution. To study the dispersal and subsequent viability of introduced seeds, he soaked various seeds in a tub filled with seawater and counted which of the seeds floated after a given period; later he planted the seeds in the yard at Down to look for potential viability. There was no attempt at controlled, replicated experiments in these studies, or in his work with domesticates, nor should there have been. To Darwin the results of one experiment represented a potential truth of nature, and he was quick to seize upon these results as supporting evidence for his theory.I have suggested in this paper that his work on domesticates was not simply meant to provide an analogy for natural selection but rather became a research program to investigate other aspects of his natural selection theory, especially inheritance and variability; these subjects were integral parts of his theory of natural selection, but by 1859 he had not found a mechanism to account for them. The experiments brought home the difficult problems of inheritance, and Darwin specifically formulated pangenesis to account for these problems. Pangenesis was not an afterthought but an integration of several decades of thinking on inheritance. It was a unified theory to explain the complicated results he witnessed in his own experiments.Much of the Darwin scholarship has focused on Darwin's path toward the discovery of natural selection. Natural selection per se was a major interest, but not the only area of interest to Darwin. Inheritance was an area of serious concern for him both before and after he had formulated natural selection. His experimentation with domesticates was an attempt to look beyond natural selection and to concentrate on the difficult subject of inheritance. He found inheritance especially troublesome, requiring a “provisional hypothesis” to account for it. To see domesticates, as they are described in the Origin, as merely an analogy for natural selection, does not account for the importance Darwin placed on them. For him they were not man's monstrous productions, but worthy experimental subjects providing him with crucial information on inheritance. (shrink)

1 Timothy and the Pastoral Letters appear to be efforts to codify structure and roles in the early church. These efforts largely reflected the patriarchal social structures of the time and as such are not relevant to the twenty-first-century church. But some of the concerns identified herein, for example expectations of church leaders, are useful for a current discussion. What is missing is any acknowledgement of the potential for identified church leaders to take advantage of vulnerable congregants, particularly women and (...) children. Aquinas, Aristotle, and the Promise of the Common Good, first published in 2006, claims that contemporary theory and practice have much to gain from engaging Aquinas's normative concept of the common good and his way of reconciling religion, philosophy, and politics. Examining the relationship between personal and common goods, and the relation of virtue and law to both, Mary M. Keys shows why Aquinas should be read in addition to Aristotle on these perennial questions. She focuses on Aquinas's Commentaries (...) as mediating statements between Aristotle's Nicomachean Ethics and Politics and Aquinas's own Summa Theologiae, showing how this serves as the missing link for grasping Aquinas's understanding of Aristotle's thought. Keys argues provocatively that Aquinas's Christian faith opens up new panoramas and possibilities for philosophical inquiry and insights into ethics and politics. At time scales of approximately 1/3 of a second, orienting movements of the body play a crucial role in cognition and form a useful computational level embodiment level,” the constraints of the physical system determine the nature of cognitive operations. The key synergy is that at time scales of about 1/3 of a second, the natural sequentiality of body movements can (...) be matched to the natural computational economies of sequential decision systems through a system of implicit reference called deictic in which pointing movements are used to bind objects in the world to cognitive programs. This target article focuses on how deictic bindings make it possible to perform natural tasks. Deictic computation provides a mechanism for representing the essential features that link external sensory data with internal cognitive programs and motor actions. One of the central features of cognition, working memory, can be related to moment-by-moment dispositions of body features such as eye movements and hand movements. (shrink)

Taking up James Gustafson's (...) question, "What is God enabling and requiring us to be and to do?" she offers a nuanced view of virtuous discernment and action in the context of the "ecclesial oppression" of women. Patrick asks, "What is correct 'church practice' for female moral agents in view of the institutionalized injustice toward women in Catholicism?" (59).Chapter 1 begins with cases of conflict between women's religious congregations and clerical leadership. In the first case, Sisters of the Holy Names of Jesus and Mary protested intolerable living conditions at a parish in Brooklyn, New [End Page 201] York, in 1939. When repeated requests for heat fell on the pastor's deaf ears, the sisters requested to leave the parish and were told that they would then also have to leave another thriving ministry in the diocese. The sisters acquiesced to this decision in a spirit of obedience and did not publicize the real reason for their departure. Fifty years later in Miami, Florida, when another conflict arose, the sisters involved discerned a very different response to injustice, one marked by concern for "justice, honesty, and personal responsibility." Bergson never dared to entitle his own work in such a fashion. However, his philosophical contribution on the workings of intelligence deserves such a high title. This article seeks to elucidate Bergson's contribution to philosophy in terms of his anticipation of several developments in human understanding. The work begins by investigating the relation between thought and the world (reality) by reviewing a series of constructivist concepts. In many ways, constructivism is related to both structuralism and post-structuralism, however this work does (...) not seek to detail these interrelations in any overt way. Instead, these concepts lay the groundwork for a review of Bergson's discussion of intellect in relation to life, psyche, and modern physics. Central concepts include limitation, circularity, and complementarity. Ultimately, the article seeks to display how Bergson's work is not only a precursor to constructivism but lays the foundation for a modified constructivism that can achieve a rigorous philosophical level. The proposed ground for the intellect is in the organic. Such an epistemological foundationalism would ultimately justify an evolutionary epistemology, in that, the structuring of the organic is evolving and thus the structuring of intellect would likewise evolve. Clarifying such an epistemology may aid in developing Delueze's an-organic bergsonism. (shrink)
